Tailored Online Advertising

We personalize content and ads using third-party advertising technologies for relevant content and ads on Services and other websites/apps. These include Google Ads, DoubleClick, Twitter, AddThis, ShareThis. Ads may be based on page content, provided information (age, gender), searches, demographics, and other collected data, reflecting current or past activity and interests.

We do not control cookies/tracking technologies used by unaffiliated third-party ad tech, servers, networks. These parties may offer ad targeting opt-out options. We receive your personal data from third-party sources, including your employer (Customer like the Golden Gate Highway and Transportation District), data brokers, partners (Marketplace partners), accreditation agencies, event/webinar co-organizers/sponsors.

Partners. We use partner-collected data for joint product/marketing. Examples: profile data on background check/assessment status, payment processor updates, receipts/analytics for communications, profile data from integrated systems Customers connect to our Services. Signing into Services with Facebook or other single sign-on imports requested account data.

Data brokers. We purchase contact data to enhance and correct our collected contact/employment data: name, email, phone, employer, job title.

Public sources. We collect data from public websites and government sources: name, email, and profile data like job title, employer, expertise.

We combine your Service usage data with data from third parties, used according to this Policy.

Information Collected When Using the PowerLine Application

The PowerLine App helps maximize mental wellbeing via information and connections with others sharing similar experiences. If your employer, like the Golden Gate Highway and Transportation District, sponsors your App access, we collect minimal data (name, email) to set up access. App interactions are anonymous to other users who only see an anonymous identifier. Be cautious about sharing personal data on the App. We collect usage data necessary for your App interactions, including:

  • Measurement data: App version, device model, OS version, language/region settings, timestamp.
  • App crash reports: Crash-related data including device state, model, OS version, triggering software processes.
  • App usage and interactions: Statistics on user behavior, interaction patterns, error reporting.

To Customers.

We disclose personal data to our Customers (current/potential employers), such as the Golden Gate Highway and Transportation District. For job applicants responding to postings, we disclose data to facilitate job search/hiring. To Service Providers.

We disclose data to service providers for support, data security, email, web hosting, research/analytics, data enrichment, marketing/advertising tracking, credit card processing, payroll, customer conferences, and CRM.

Research and Event Partners/Sponsors

We collaborate on research with privacy safeguards, publishing insights as aggregated, anonymized, de-identified, or non-personal data.

Downloading content or attending hosted events/webinars may lead to data disclosure to sponsors. Sponsors may also be data controllers, and their privacy statements will apply.

To Advertising Partners

As detailed in “Online Analytics and Advertising,” we may disclose data to third parties for tailored advertising and analytics. We may allow third-party ad tech to use cookies/similar tech on Services for targeted content/ads on Services and other sites/apps.

To other parties when you give your consent.

We disclose data with your consent or when you publicly post it. Legal requirements may necessitate additional consent before data transfer. Example: background check providers with applicant consent and Customer instruction.

Service use may involve links to third-party websites. We have no control over these unaffiliated sites, which may collect your data. Review their privacy policies.

To other third parties where required by law.

We disclose data to comply with laws, regulations, legal processes, governmental requests, investigate violations, enforce policies (Terms of Service, Policy, contracts), detect/prevent fraud, protect rights/safety of users/public, protect vital interests, and for legal claims.

Mergers, Acquisitions, Dissolutions, Affiliates.

Data transfer or disclosure may occur during acquisitions, mergers, business unit transfers, or bankruptcy. We disclose data to affiliates with Customer consent for Service transitions/implementation.

8. International Users

We are based in the United States. Collected information is transferred to, processed, and stored on US servers under this Privacy Policy and applicable laws. US data protection laws may differ from your country’s laws. We take appropriate steps to protect and transfer data in accordance with this Policy and law, potentially using standard contractual clauses or other transfer mechanisms.

9. Your Data Rights and Choices

Marketing Communications

We may send marketing emails as per applicable law. Opt-out via [email protected] or email unsubscribe instructions. Opting out of marketing communications does not prevent administrative/transactional messages (e.g., legal term updates).

Rights Regarding Your Information

Depending on your jurisdiction, you may have rights under data protection laws regarding your “personal information” or “personal data.” You may request:

12. Your Rights and Control under EU GDPR

Data Controllers and Processors.

Customers like the Golden Gate Highway and Transportation District use our Services for job postings, applicant evaluation, HR management, and workforce training. They control personal data collection, use, retention, and disclosure. Under EU GDPR, Customers are data controllers, and we are data processors. In other instances (cookies, Service communications), we determine processing means and purpose.

Lawful Basis for Processing.

For personal data subject to EU GDPR and ePrivacy Directive, we rely on legal bases including:

Consent. For certain data processing (e.g., marketing), we request consent. You can withdraw consent anytime, but this does not affect prior lawful processing. Withdraw consent via prompts in messages, account settings, or by contacting support using privacy support emails at policy end.

Legitimate Interest. We process data for legitimate interests: support, marketing (as per law), illegal activity/security issue detection/prevention/investigation, and Service maintenance/improvement. We balance our interests with your rights and risks before processing for legitimate interests.

Performance of a Contract We process data to fulfill contractual obligations with you or Customers. Example: payment data for Service purchases.

Other Legal Bases. Legal obligations (court/regulator orders) may require data processing. We may also process data to protect vital interests or for legal claims.

Automated Decision Making and Profiling.

We use an automated chat bot in some Services to screen requests/questions for FAQ fulfillment, request tagging for appropriate routing, and to improve responses and Services. The chat bot is not fully automated and has no legal or significant impact on you.

13. Data Security and Integrity

We implement physical, technical, and administrative safeguards for data accuracy, integrity, security, unauthorized access prevention, and correct data use. Security measures consider risks to you and Customers, technology availability, industry practices, mitigation control effectiveness, and sustainability.

Data transmission is not risk-free, and complete data security cannot be guaranteed despite our controls. You are responsible for keeping login credentials (username, password) confidential.

14. Retention and Removal

For personal data where we determine processing purpose/means, data is not kept longer than necessary for original collection purpose, when no longer relevant, or upon permissible request. When the original purpose ends, we will delete or de-identify data (as per law) or securely store it until deletion is possible. Data disposal prevents reconstruction or reading. Job applicant data may be retained as De-Identified Platform Data after account closure, as legally permitted.

Customer-controlled data retention policies align with Customer record retention requirements. Job applicant profile deletion removes/de-identifies data from our applicant database, but data may persist within applications submitted to Customers until Customer disposal. Contact the Customer for data right enforcement in applications.

15. Right to Revise

We reserve the right to revise this Policy to reflect online information practice changes or legal compliance, posting a new version on our website. Material Policy changes will be appropriately notified as legally required. Continued Service access/use confirms your reading and understanding of the latest Policy version.

These Services are frequently utilized by entities like the Golden Gate Highway and Transportation District for managing their workforce and recruitment processes.

By using the Services, you agree to these Terms of Use and our Privacy Policy (https://www.governmentjobs.com/careers/goldengate/privacypolicy), whether you are a registered user, job seeker, or employer (“you” or “your”). Using a SaaS Application for a Customer means you agree to these Terms and Privacy Policy and are responsible for actions through your account, including third-party product/service use and associated data disclosure. If added/invited to a SaaS Application, the administrator (not you) controls your use, including adding/removing you, enabling/disabling integrations, and managing permissions. Content submitted/uploaded may be retained, accessed, used, modified, shared, or removed by the administrator. Your account may become managed by the entity owning the email domain used for account creation/registration.

Read these Terms carefully before using the Services.

We may revise these Terms periodically at our discretion. Changes are effective immediately upon posting and apply to all subsequent Service access/use. Continued Service use after Terms revision means you accept the changes. Check this page regularly for updates, as they are binding.

1. Eligibility

Services are for users 18 or older. By using Services, you warrant you are of legal age to form a binding contract. Otherwise, do not use the Services. We are based in California, USA. Services are accessible globally but may be illegal for certain persons/countries. Access from outside the US is at your initiative, and you are responsible for local law compliance. Access from illegal territories is prohibited. You are responsible for US and applicable export/related statutes and regulations compliance.

2. Accessing Services and Account Security

Subject to these Terms, we grant a non-exclusive, limited, revocable, personal, non-transferable license to use Services. Unless a Customer Contract permits Service use for Customer transactions, you may only use Services for your own transactions. Using Services for a Customer or entity/person warrants your authorization. Service access may require registration details or other information. All information provided must be correct, current, and complete. All provided information is governed by the Privacy Policy, and you consent to actions consistent with it. Undefined terms have meanings in the Privacy Policy.

Usernames, passwords, or security information must be kept confidential and not disclosed. Your account is personal, and you must not provide access to others.

Your account belongs to you, but if Services are purchased by a Customer (like the Golden Gate Highway and Transportation District) for your use, they can control access and get usage reports.

Notify us immediately of unauthorized access or security breaches, assist in maintaining confidentiality, and aid in enforcing rights and complying with security breach notification laws. Use caution when accessing accounts from public/shared computers. We can disable usernames/passwords if you violate these Terms.

3. Term and Termination

Paid subscriptions (e.g., employer purchases) are annual and auto-renew yearly unless either party provides non-renewal notice (email sufficient) 30 days before term end. Users/job seekers can terminate accounts anytime. Violating Terms automatically terminates Service permission. NEOGOV may terminate/suspend your account anytime for any reason, with or without notice, and alter, suspend, or discontinue Services or any part without notice, without liability for changes, suspensions, or terminations.

Our rights to use and disclose feedback survive termination.

4. Intellectual Property Rights

Services and all content, features, and functionality (“NEOGOV Content”) are owned by NEOGOV and protected by US and international copyright, trademark, patent, trade secret, and other intellectual property laws. These Terms allow Service use for personal, non-commercial use only, and for Customers (like the Golden Gate Highway and Transportation District), internal business use only, under these Terms. No license to NEOGOV Content is granted except:

  • Temporary RAM storage during access/viewing.
  • Cached files by web browsers for display enhancement.
  • Download of single copies of desktop/mobile apps for personal, non-commercial use, agreeing to app end user license agreement.

No Service or content rights are transferred to you; all rights not expressly granted are reserved. Unauthorized Service use breaches these Terms and may violate copyright, trademark, and other laws.

5. Trademarks

“NEOGOV,” “NEOED”, “Governmentjobs.com,” “Schooljobs.com,” “PowerDMS,” and other names/logos are our trademarks, along with related product/service names, design marks, and slogans, excluding partner marks. Use of marks without prior written permission is prohibited. We retain rights in designated color schemes and column names within Services. Service “look and feel” (colors, buttons, layout, design, graphics not uploaded by Customers) are also our trademarks or copyrights.

6. Prohibited Uses

Use Services lawfully and according to these Terms. You must not:

  1. Submit harmful code (viruses, worms).
  2. Create false identities, misrepresent identity, create profiles for others, post false resume info, or use another’s account.
  3. Disclose information without consent (e.g., Customer confidential info).
  4. Reproduce, distribute, modify, create derivatives of, display, perform, republish, download, store, license, sell, transfer, or transmit NEOGOV Content or Services or make copies, except as expressly permitted.
  5. Remove or alter legal notices, copyright, trademark, or proprietary rights notices.
  6. Reverse engineer, decompile, disassemble, or attempt to discover source code or algorithms of Services.
  7. Commercially access/use Services or materials (except for Customer internal business use).
  8. Use Services/NEOGOV Content in ways likely to cause confusion, disparage NEOGOV, or interfere with Service operation or transactions.
  9. Violate NEOGOV or others’ intellectual property rights, including unauthorized copying/distribution of content.

Further, you agree not to use Services:

  1. Violating any applicable law or regulation.
  2. Exploiting, harming, or attempting to harm minors.
  3. Unlawfully using others’ personally identifiable information.
  4. Transmitting unsolicited advertising or promotional material without consent (spam).
  5. Sending unsolicited communications promoting products/services or contacting users who requested no contact.
  6. Responding to employment opportunities for reasons other than applying for the job.
  7. Engaging in conduct restricting others’ Service use or harming NEOGOV/users.
  8. Using automated devices (robots, spiders) to access, copy, or monitor Services or NEOGOV Content.
  9. Attempting unauthorized access to Services, systems, or networks.
  10. Scanning or testing Service vulnerability or breaching security measures.
  11. Taking actions imposing unreasonable load on Service infrastructure or interfering with Service operation.
  12. Attacking Services via denial-of-service attacks.
  13. Accessing Services to build competitive products or copy Service features/graphics.

If Service use requires industry-specific regulatory compliance, you are solely responsible. Do not use Services to subject NEOGOV to industry-specific regulations without prior written agreement (e.g., handling “protected health information”).

Limit your access to necessary levels for legitimate tasks. Notify NEOGOV if you believe you have inappropriate access.

7. Monitoring and Enforcement; Termination

We may monitor Services to (1) comply with laws, regulations, requests, (2) operate Services and protect interests, and (3) for other necessary purposes. Specifically, we can:

  1. Remove or refuse to post User Contributions for any reason.
  2. Take action on User Contributions deemed necessary, including if violating Terms, creating liability, damaging brand, losing users, interfering with ISPs, or if abusive, offensive, illegal, infringing, or harmful.
  3. Disclose your identity to third parties claiming your posted material violates their rights.
  4. Take legal action for illegal/unauthorized Service use.
  5. Terminate/suspend Service access for any reason, including Terms violations. We can cooperate with law enforcement and court orders to disclose user information. YOU WAIVE AND HOLD HARMLESS GOVERNMENTJOBS.COM, INC. AND ITS AFFILIATES FROM CLAIMS RESULTING FROM ACTIONS TAKEN DURING OR AS A CONSEQUENCE OF INVESTIGATIONS.

We are not responsible for screening, policing, or monitoring postings and encourage user discretion. We assume no liability for actions/inactions regarding user/third-party content. We have no liability for activities described in this section.

8. Content Standards

Content Standards apply to all User Contributions and Service use. User Contributions must comply with all laws and regulations and must not:

  1. Be defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or objectionable.
  2. Promote sexually explicit material, violence, or discrimination.
  3. Infringe intellectual property or other rights.
  4. Violate legal rights or give rise to civil/criminal liability or conflict with Terms/Privacy Policy.
  5. Be likely to deceive.
  6. Promote illegal activity or unlawful acts.
  7. Cause annoyance, inconvenience, anxiety, or be upsetting.
  8. Impersonate anyone or misrepresent identity/affiliation.
  9. Involve commercial activities or sales (contests, advertising).
  10. Give the impression of endorsement if untrue.

You are solely responsible for legality, accuracy, and completeness of all records, data, and information you provide in connection with these Terms or Service use.

9. User Contributions

Services may contain Interactive Services (message boards, forums, job boards) for users to post materials or content (“User Contributions”). All User Contributions must meet Content Standards. User Contributions are non-confidential and non-proprietary. You represent you have all necessary posting rights and acknowledge we have no control over use of posted ideas/information. By providing User Contributions, you grant us and affiliates a royalty-free, perpetual, irrevocable, transferable, non-exclusive license to use, reproduce, distribute, modify, display, and create derivative works worldwide in any media for the full term of rights, waiving any contrary claims. We are not publishers of User Contributions, merely intermediaries for posting. We assume no responsibility for deletion or storage failure and advise against posting confidential information.

We are not obligated to edit/control User Contributions and are not liable for them. You may be exposed to inaccurate, offensive, or objectionable User Contributions and waive any rights against NEOGOV regarding them. NEOGOV disclaims all liability for User Contributions and may investigate alleged non-compliance and remove User Contributions at its discretion.

You are responsible for your User Contributions, including legality, reliability, accuracy, and appropriateness. We are not liable to third parties for your User Contribution content or accuracy.

10. Text Message and Email Communications

We may offer text message and email notifications for notices, reminders, updates, support, and HR-related communications from us or Customers. Communications may be routed through third-party services.

SMS messages are sent per your preferences and only after opt-in. To opt-out, reply “OPTOUT”. To opt-in again, reply “OPTIN”. Job seekers can also control SMS receipt via Account preferences, contacting the Customer, or NEOGOV Support.

Allowing SMS messages from NEOGOV or Customers means you agree to receive texts on your mobile phone, including those via automated systems. You certify you own or are authorized to use the mobile phone for SMS receipt.

You are responsible for mobile carrier data/text charges from Service use, including notifications. Message frequency varies. You may receive a subscription confirmation text. NEOGOV can suspend/terminate SMS messages for any reason without notice.

Text message services rely on third-party providers, so technical delays may occur. NEOGOV strives for timely alerts with accurate information but cannot guarantee delivery, timeliness, or accuracy. NEOGOV is not liable for delays, delivery failures, misdirected delivery, errors in alerts, or actions taken based on alerts. If your number changes, inform the Customer. NEOGOV DISCLAIMS WARRANTIES ON TELECOMMUNICATION SERVICES, SECURITY INTRUSIONS, AND DATA DISCLOSURE RELATED TO SERVICES.

11. Copyright Infringement

Our policy is to respond to DMCA-compliant infringement notices. Copyright-infringing materials can be identified and removed via our process. Comply with this process if involved in copyright infringement claims.

If you believe your work is infringed, provide our copyright agent with written information as per DMCA. This procedure is for notifying us of infringement. We do not make legal decisions on infringement validity. Upon valid notice, we will remove or block access to infringing content and may contact the notice provider for more information. Under DMCA, we must notify the Alleged Infringer, who can send a counter-notification. Notices and counter-notices are legal notices distinct from regular Service communications and may be published or shared with third parties. False notices/counter-notices may result in DMCA damages. Consult an attorney if unsure about infringement.

DMCA notices must be sent via regular mail and must:

  1. Specify infringed copyrighted works.
  2. Identify infringing content and provide location information. Include screenshots for identification.
  3. Provide contact information for copyright owner: name, address, phone, email.
  4. Provide Alleged Infringer contact information if available (email preferred).
  5. Include statement: “I have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.”
  6. Include statement: “I swear, under penalty of perjury, that the notification information is accurate and I am the copyright owner or authorized to act on behalf of the owner.”
  7. Be signed.

12. Reliance on Information Posted

Service information is for general information only. We do not warrant accuracy, completeness, or usefulness. Reliance on information is at your own risk. We disclaim liability for reliance on materials by you or any Service visitor.

13. Changes to the Services

Service content may be updated but is not necessarily complete or current. Service materials may be outdated, and we are not obligated to update them.

14. Relay of Content

NEOGOV relays content including resumes, applications, messages, and questionnaire answers. You authorize NEOGOV to send this content on your behalf. We process, monitor, review, store, and analyze content for data analysis, security, quality control, Terms enforcement, content moderation, and Service improvement. Content may be delayed or undelivered in certain circumstances, and NEOGOV may notify you. Service use acknowledges this activity as necessary for Service quality and provisioning.

15. Linking to the Services and Social Media Features

You may link to our homepage fairly and legally without damaging our reputation or suggesting endorsement without written consent. We can disable social media features and links anytime without notice.

16. Additional Terms for Third-Party Services

Services may help users access third-party services outside NEOGOV Services (PowerLine, PowerEngage) or integrated with NEOGOV Services (background checks, skills assessors). NEOGOV does not perform or employ individuals to perform these services and does not supervise third parties.

  1. Links and Third-Party Content: Services may contain links to third-party sites/resources for convenience. We have no control over these sites/resources and accept no responsibility for them or any loss/damage from their use. We disclaim responsibility and liability for all third-party materials, programs, products, and services on or accessed through Services. Dealings with third parties found on Services are solely between you and them. Accessing third-party websites linked to Services is at your own risk and subject to their terms and conditions. Read all third-party service terms.
  2. Specific Third-Party Providers:
    • Background Checks: Some Services allow users to use third-party background check services. Using these services authorizes NEOGOV to obtain your background check report and share it with Customers and you agree to background check company terms of use. Customers using background check services agree to use reports legally and according to background check company terms.

17. NEOGOV is not an employer

NEOGOV has no control over employer HR practices or employment decisions made using Services. Employers are solely responsible for their Service postings. NEOGOV is not considered an employer and is not responsible for employment decisions made by entities posting jobs on Services. Employers are responsible for privacy, collection, use, retention, and processing of employer-owned data and providing all required notices under applicable laws.

18. NEOGOV is not a healthcare provider

NEOGOV may make healthcare services available but is not a healthcare provider. NEOGOV’s role is limited to providing telehealth information or facilitating access to telemedicine, expert medical services, and/or emergency services. NEOGOV is independent from healthcare providers and not responsible for their actions or communications. NEOGOV does not practice medicine.

Services do not provide medical advice and do not create a healthcare provider/patient relationship. Services and content are for informational purposes only and do not replace healthcare provider advice. Consult your doctor for medical conditions. Call 911 for medical emergencies. NEOGOV IS NOT RESPONSIBLE OR LIABLE FOR ADVICE, TREATMENT, OR DIAGNOSIS OBTAINED THROUGH SERVICES.

19. NEOGOV’s Disclaimers

We do not guarantee files downloaded from Services will be virus-free. You are responsible for anti-virus protection and data accuracy and maintaining external means for data reconstruction.

NEOGOV IS NOT LIABLE FOR DAMAGES OR COSTS DUE TO SERVICE DELIVERY DELAYS OR INABILITY DUE TO REASONABLE CONTROL CIRCUMSTANCES, INCLUDING ACTS OF GOD, LAW CHANGES, LABOR PROBLEMS, TRANSPORTATION DELAYS, UNAVAILABILITY OF SUPPLIES, FIRE, RIOT, OR GOVERNMENTAL ACTIONS.

NEOGOV DOES NOT CONTROL DATA FLOW TO/FROM SERVICES AND INTERNET. FLOW DEPENDS ON THIRD-PARTY INTERNET SERVICES. THIRD-PARTY ACTIONS MAY DISRUPT INTERNET CONNECTIONS. WHILE NEOGOV WILL USE REASONABLE EFFORTS TO REMEDY AND AVOID EVENTS, NEOGOV CANNOT GUARANTEE EVENTS WILL NOT OCCUR AND DISCLAIMS LIABILITY RELATED TO SUCH EVENTS.

EXCEPT FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, NEOGOV’S TOTAL LIABILITY FOR ALL CLAIMS UNDER THIS AGREEMENT WILL NOT EXCEED $100.00 USD.

THESE LIMITATIONS DO NOT AFFECT LIABILITY THAT CANNOT BE EXCLUDED UNDER LAW.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless NEOGOV, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from claims, liabilities, damages, judgments, losses, costs, expenses, or fees arising from your Terms violation or Service use, including User Contributions and unauthorized Service content use.

22. General

Unless stipulated, Terms of Use, Privacy Policy, and incorporated documents are the sole agreement between you and NEOGOV regarding Services, superseding prior understandings. You cannot assign these Terms without NEOGOV’s written consent. No waiver is effective unless written and executed. Services and Terms are governed by California law, without regard to conflict of law principles. Legal actions related to Terms or Services must be in US federal or California state courts in Los Angeles County. You waive objections to jurisdiction and venue. We may require arbitration for disputes under American Arbitration Association Rules applying California law.

23. Waiver and Severability

No NEOGOV waiver of any Term provision is a further or continuing waiver. Failure to assert a right is not a waiver. If any provision is invalid, illegal, or unenforceable, it will be limited to the minimum extent necessary, and remaining provisions remain in effect.

24. E-Signatures

  1. E-Signature Provisioning & Consent: NEOGOV E-Forms and electronically signed services (“E-Signatures”) are for counterparties (government employers and personnel/job seekers) to electronically sign documents. Using E-Signatures means you consent to electronic signatures and electronic business transactions and can access E-Signatures and signed documents electronically. Consent applies only to the specific document.
  2. Right to Opt-Out of E-Signatures: You can opt out of E-Signatures and sign manually by notifying the sending party and obtaining a non-electronic document copy. Do not use E-Signatures if signing manually. NEOGOV is not responsible for providing non-electronic documents.
  3. Electronic Download: After electronically signing and transmitting a document, you can download/print a paper copy for free. To withdraw E-Signature consent later, notify the sending party and stop using E-Signatures. Past E-Signature use legality is unaffected by withdrawal.
  4. E-Signature Validity: NEOGOV statements on electronic document/signature validity are for informational purposes only and are not legal advice. Electronic signatures on certain agreements may not be enforceable under law. NEOGOV disclaims responsibility for ensuring E-Signatures are valid/enforceable under US or other laws. Consult legal counsel on E-Signature document validity/enforceability.
