Vehicle Transport Trailer Rental Terms and Conditions

THESE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT IMPACT YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ THIS PROVISION CAREFULLY.

1. RENTAL AGREEMENT: We, worldtransport.net, rent to you the vehicle transport trailer and any accompanying equipment listed in your Rental Document (collectively referred to as the “Trailer”). This may include, but is not limited to, straps, tie-downs, and other accessories necessary for the safe and secure transport of vehicles. You acknowledge that this rental is solely a bailment for mutual benefit. The Trailer remains our property, and you have no right to sublease, transfer, or assign it. Any attempt to do so is void and a breach of this agreement. You, and any permitted driver, are not our agents, servants, or employees for any purpose. “You” and “your” refer to the person signing the Rental Document. “We,” “us,” and “our” refer to worldtransport.net, the Vehicle Transport Trailer Rental provider.

2. ENTIRE AGREEMENT: This document, along with the Rental Document you sign, any supplemental forms or brochures provided, and the final return record detailing rental charges, constitutes the complete rental agreement between you and us. It is the only agreement concerning this rental. Any changes to this agreement or our rights must be in writing and signed by an authorized worldtransport.net officer. You also agree that you are not our agent for any purpose. Keep your copy of this agreement with you throughout the rental period. By signing the Rental Document, you agree to all terms and conditions within this agreement. Should any part of this agreement be deemed unenforceable by a court, the remaining provisions will still apply.

3. TRAILER CONDITION AND DISCLAIMER: By renting, you acknowledge that you have inspected the vehicle transport trailer and confirm it is in good, working condition, suitable for your vehicle transport trailer rental needs, and free from apparent defects, except as noted on our Vehicle Damage Inspection form. YOU AGREE THAT WE PROVIDE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, REGARDING ANY ASPECT OF THE RENTAL. THIS INCLUDES, BUT IS NOT LIMITED TO, THE TRAILER’S CONDITION, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. UNLESS LEGALLY REQUIRED, WE ARE NOT LIABLE FOR ANY PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR COMPENSATORY DAMAGES ARISING FROM THIS AGREEMENT, THE PROVISION OF THE TRAILER, OR ITS USE.

4. PROHIBITED USES AND AGREEMENT TERMINATION: Certain uses of the vehicle transport trailer, or actions (or inactions) by you or any authorized driver, will breach this agreement. VIOLATION OF THIS SECTION AUTOMATICALLY TERMINATES YOUR RENTAL AND VOIDS ALL LIABILITY PROTECTION AND OPTIONAL SERVICES YOU MAY HAVE ACCEPTED, including but not limited to liability protection, supplemental liability insurance, personal accident insurance, cargo protection, extended roadside assistance, optional physical damage waiver, limited damage waiver, or commercial damage waiver. You will also be liable for all penalties, fines, forfeitures, liens, recovery, and storage costs, including all associated legal expenses, fees, and costs we incur. Prohibited uses include:

a) Reckless or Illegal Use: Using the trailer recklessly or for any conduct that could be charged as a felony or misdemeanor, including transporting illegal substances or contraband.

b) Unauthorized Towing: Using the trailer to tow anything other than vehicles in accordance with the rental agreement and safety guidelines. This includes towing other trailers or using the vehicle transport trailer for purposes it is not designed for.

c) Overloading and Improper Loading: Operating the trailer when overloaded beyond its Gross Vehicle Weight Rating (GVWR) or with an improperly placed or unsecured load. Always adhere to the manufacturer’s weight limits and secure all transported vehicles properly.

d) Unauthorized Drivers: Allowing anyone other than you or an Authorized Additional Driver to operate the towing vehicle or manage the trailer.

e) Misuse and Off-Road Use: Using the trailer in races, tests, contests, or off paved roads or improved surfaces. Vehicle transport trailers are designed for on-road use only.

f) Continued Use with Damage: Operating the trailer when you know, or should know, that continued use is likely to cause damage to the trailer or towing vehicle.

g) Negligence and Security: Using the trailer in a way that aids in its vandalism or theft, such as leaving it unsecured or with keys readily accessible.

h) False Information: Obtaining the trailer rental based on false or misleading information.

i) Driving Under the Influence: Operating the towing vehicle while under the influence of alcohol or controlled substances.

j) Improper Cargo: Transporting any car, truck, animal, or human being inside or on the vehicle transport trailer in a manner not intended or unsafe.

k) Dangerous Locations: Using the trailer in areas posing unusual risks of damage, such as areas of civil unrest, natural disasters (hurricanes, floods, fires, earthquakes, mudslides), where such risks are reasonably foreseeable.

l) Geographic Restrictions: Operating the trailer outside of the contiguous United States (i.e., Alaska, Canada, or Mexico) unless explicitly permitted by the rental agreement.

m) Hazardous Materials: Storing, treating, transporting, or disposing of any regulated, toxic, or hazardous substances or waste, including corrosive, poisonous, flammable, explosive, accelerant, radioactive substances, and biohazards.

n) Improper Fueling: Improperly fueling the towing vehicle (e.g., using gasoline in a diesel vehicle or vice versa), or improper handling of Diesel Emission Fluids (DEF) if applicable to the towing vehicle.

o) Failure to Report Damage: Failing to promptly report any damage to or loss of the trailer when it occurs or when you become aware of it, failing to provide a written accident/incident report, failing to cooperate with our investigation, or failing to report an accident to law enforcement as required by law.

p) Intentional Acts: Intentional acts or torts that cause damage to the trailer or other property.

q) Unauthorized Recording: Recording our trailers, trademarks, service marks, or copyrighted material, including logos, without our express written consent, except as permitted by law.

5. AUTHORIZED DRIVERS: You confirm that you are a licensed and capable driver and that your license is valid and unrestricted. In addition to you, only the following individuals are authorized to operate the towing vehicle and manage the vehicle transport trailer: a) For personal rentals: individuals listed on the rental document at the start of the rental (spouses and domestic partners must be listed). Additional driver fees may apply. b) For commercial rentals without a pre-established account: only the person listed as the driver on the Rental Documents. Additional authorized drivers may be added for a fee (employees, fellow employees, employers, or business partners engaged in business purposes with explicit permission). c) For commercial rentals with a pre-established account: employees, fellow employees, employers, or business partners engaged in business purposes, with explicit permission, provided the rental originates through the established account. ALL DRIVERS, INCLUDING YOU AND ANY AUTHORIZED ADDITIONAL DRIVERS, MUST BE AT LEAST 18 YEARS OF AGE, PROPERLY LICENSED, AND QUALIFIED, WHICH MAY INCLUDE HOLDING AN APPROPRIATE COMMERCIAL DRIVER’S LICENSE (CDL) DEPENDING ON THE TOWING VEHICLE AND TRAILER COMBINATION AND LOCAL REGULATIONS. It is your responsibility to determine and obtain the necessary licenses, permits, signage, and documentation to operate the towing vehicle and trailer. Drivers with alcohol interlock restrictions are prohibited from renting or operating the trailer. Additional daily charges may apply for drivers under 24 years of age. Other requirements may apply as determined by us.

6. FUEL RESPONSIBILITY: Rental rates do not include fuel costs for the towing vehicle. The towing vehicle will typically have a full tank at the start of the rental. You are responsible for all fuel costs during the rental period. If the return location does not sell fuel or offer refueling service, you must return the towing vehicle with a full fuel tank. If refueling services are available, you may choose to refuel at the return location at their posted rates or at any fuel retailer of your choice. If you choose not to refuel before returning the towing vehicle, you will be charged a refueling service fee, in addition to the cost of fuel. Fuel and refueling services may not be available at all locations, and charges will vary. Refueling service rates may be higher than retail fuel prices. Contact the return location to verify fuel availability and charges before returning the towing vehicle.

7. TRAILER RETURN: You must return the vehicle transport trailer to us in the same condition it was in when rented, on the due date and time specified in the Rental Document. We may demand its return earlier. Returning the trailer earlier or later may result in rate adjustments and late return fees. Unless otherwise specified, return the trailer to the original rental location. RETURNING THE TRAILER TO AN INCORRECT LOCATION WILL INCUR ADDITIONAL CHARGES AND MAY ALTER YOUR RENTAL RATE. If no due date and time are specified, return the trailer upon our demand or within three (3) days of the rental date, whichever is earlier. FAILURE TO RETURN THE TRAILER BY THE DUE DATE AND TIME WILL RESULT IN LATE CHARGES AND POTENTIAL RATE CHANGES. A service charge of $25.00 or more may apply if the trailer is returned unclean or if any accessories are missing or damaged. For after-hours returns, use the designated drop box for keys and rental documents. YOU REMAIN RESPONSIBLE FOR THE TRAILER AND ALL CHARGES, LOSSES, AND DAMAGES UNTIL THE LOCATION REOPENS AND THE TRAILER IS FOUND ON THE PREMISES. If keys are not deposited and the trailer is not found, you will be in breach of this agreement.

8. REPOSSESSION: We may terminate this agreement and repossess the vehicle transport trailer at any time, at our sole discretion, with or without notice, under various circumstances, including but not limited to: illegal parking, use in violation of law or this agreement (e.g., false information at rental, unauthorized transfer), abandonment, risk of towing/impoundment/damage, or use that could harm our reputation. You are responsible for all repossession costs, including fines, towing, impound fees, and reasonable attorney fees. If you fail to return the trailer by the due date/time, or upon our demand, or if the rental was based on false information, we may consider the trailer converted or stolen and take legal action for recovery without further notice.

9. BREACH OF AGREEMENT AND PROPERTY HANDLING: If you breach this agreement, you are liable for our damages, reasonable costs, expenses, administrative fees, and attorney’s fees to enforce the agreement. Upon repossession, we have a lien on any property in or attached to the trailer for all unpaid charges and expenses. You grant us a security interest in such property. This agreement may serve as a financing statement. We may act as your agent to unload, inventory, store, and manage such property, incurring reasonable associated costs. If you fail to pay all due charges and expenses, or fail to retrieve your property after payment, we (or our agents), acting as your agent, may dispose of or donate the property at our discretion without prior notice. Similarly, we may dispose of or donate any property left on our premises or in the trailer and not retrieved within thirty (30) days of abandonment or trailer recovery, acting as your agent without prior notice.

10. RENTAL CHARGES AND PAYMENT:

A. You agree to pay all charges under this agreement, including rental fees, cost recovery fees, airport/concession fees, energy recovery fees, surcharges, taxes, and any other applicable fees and monies due. Payment must be made using a method acceptable to us. Unless otherwise determined later, all charges are due upon trailer return. We may apply any deposit towards these charges. If using a credit card, we may reserve an amount based on estimated charges, and charge any amounts due, including post-return charges, to that card. Credit card payments are subject to your cardholder agreement. For check payments, you agree to pay a fee for any dishonored check and associated bank charges. We are not obligated to resubmit checks. You will pay the full daily rate for each full or partial rental day or time slot as stated in the Rental Document, which is the minimum charge, even with early returns. No refunds are given for unused rental days or miles. All charges are subject to our final audit. You will pay any undercharges revealed by audit, and we will refund any overcharges.

B. Overdue Payments: For any amounts not paid when due, including loss or damage payments, you agree to pay a late charge of 1.5% per month or the maximum rate allowed by law, whichever is less, on the outstanding balance. You will also pay all collection costs, including administrative fees, recovery fees, court costs, and reasonable attorney’s fees. Where permitted, we may contact you or your employer about payment at your place of business. The address you provided in the Rental Document may be used for sending demands or collection notices.

11. MAINTENANCE AND INSPECTION: You are responsible for maintaining adequate oil and coolant levels in the towing vehicle’s engine. As instructed by us, you will arrange for necessary servicing or maintenance during the rental period. No service, repairs, part replacements, or maintenance on the trailer or towing vehicle are allowed without our prior approval. We, or our designee, may inspect the trailer at any time, wherever it is located, without prior notice. Stop using the towing vehicle and trailer and contact us immediately if any warning lights illuminate or if any mechanical issues arise, such as engine problems, flat tires, brake issues (grinding, squealing, low pedal pressure), malfunctioning lights, fluid leaks (excluding A/C condensation), or reduced power.

12. COMPLIANCE, FINES, EXPENSES, AND ADMINISTRATIVE FEES: You are responsible for complying with all laws related to the use of the vehicle transport trailer, including weight station requirements and restrictions on roads or lanes. You will pay for all taxes, special licenses, permits, fines, penalties, court costs for parking, traffic, toll violations, and other violations, including storage liens and charges. You will also pay a reasonable administrative fee for any violation of this agreement, such as for repossession or trailer recovery. We may, at our discretion, pay tickets, citations, fines, and penalties on your behalf and you agree to reimburse us for these amounts plus a reasonable administrative fee. You acknowledge that we cooperate with law enforcement to provide necessary information regarding violations.

A. TOLLING/PLATEPASS®:

You are responsible for all tolls incurred during the rental period. We offer an optional PlatePass® service that allows electronic toll payment on highways, bridges, and tunnels. Unless you opt-out (see “Opting Out of e-Toll”), you automatically enroll in PlatePass® and agree to pay the associated fees detailed in the Rental Document. If you use PlatePass® at any time during your rental, you agree to pay a convenience fee for each day tolls are incurred, up to a maximum per rental period (not exceeding 30 days), plus all tolls at the maximum non-discounted or cash rates set by the toll authority.

Opting Out of PlatePass®: Avoid PlatePass® fees by: (i) paying cash for all tolls, (ii) using your own compatible and funded electronic toll device, (iii) paying the toll authority directly online or via other services, or (iv) avoiding electronic toll roads.

Toll Administrator: PlatePass®, a third-party administrator contracted by us, processes electronic toll payments and charges your credit/debit card for tolls and convenience fees. By using PlatePass®, you agree to share your personal information (address, credit card details, rental information) with the Toll Administrator. You authorize both the Toll Administrator and us to charge your card for e-Toll fees. The Toll Administrator may contact you directly regarding e-Toll fees. Billing for e-Toll fees may take 4-8 weeks after the rental concludes. You agree to indemnify and hold us, the Toll Administrator, and any authorized agents harmless from any fines, charges, or administrative fees for toll violations. e-Toll does not cover airport parking. Use a personal transponder or other approved payment for parking.

Toll violations will incur an administrative fee up to $50 per toll issuer.

AVOID CONVENIENCE FEES AND TOLL CHARGES BY PAYING CASH, USING YOUR OWN TOLL DEVICE, OR AVOIDING CASHLESS TOLL ROADS.

You authorize us to release your rental and credit/debit card information to ATS Processing Services, LLC (ATS) as our agent for processing and billing tolls and toll violations. You authorize ATS to bill your rental card or invoice you if no card is on file. ATS is authorized to contact you about tolls, violations, tickets, fines, and penalties. If we use a third-party collection agent, you agree to pay all collection costs, including administrative and legal costs, upon demand without protest. You agree to indemnify and hold us and ATS harmless from any tolls, tickets, citations, fines, penalties, and administrative fees.

Video-Plate-Based Tolling: If you do not pay cash at toll stations or cash payment is not accepted, passing through an electronic toll automatically enrolls you in PlatePass®.

Transponder-Based Tolling: If the towing vehicle is equipped with a transponder, open the transponder box on the windshield to use PlatePass® in transponder-based toll lanes. Keep the box closed if you do not want to use the service.

13. OPTIONAL DAMAGE WAIVERS (PDW, LDW, CDW): Optional Physical Damage Waiver (PDW), Limited Damage Waiver (LDW), or Commercial Damage Waiver (CDW – for commercial accounts only) are not insurance and are not mandatory. EXCEPT FOR TIRE DAMAGE FROM CURBING OR COLLISIONS WITH OVERHEAD OBJECTS (TREES, OVERPASSES, OVERHEAD LINES, GARAGES), accepting PDW, LDW, or CDW and paying the daily fee, while operating the trailer according to this agreement, limits or waives your financial responsibility for loss or damage to the trailer as specified in the Rental Document. (“OVERHEAD” DAMAGE IS DAMAGE ABOVE THE DRIVING CAB HEIGHT OF THE TOWING VEHICLE). CDW, LDW, AND/OR PDW ARE VOID, AND YOU ARE FULLY RESPONSIBLE FOR ALL LOSS AND DAMAGE TO THE TRAILER IF IT IS USED IN ANY PROHIBITED MANNER OR IF YOU VIOLATE ANY MATERIAL TERM OF THIS AGREEMENT.

14. TRAILER LOSS OR DAMAGE RESPONSIBILITY: Unless you accept PDW, LDW, or CDW and pay the fee, you are responsible for all loss or damage to the vehicle transport trailer, regardless of fault and cause. This includes damage from collision, accident, theft, vandalism, fire, flood, explosion, natural causes, or unknown causes. You are also responsible for: diminished value after repair, actual towing, storage, impound, and related fees, loss of use based on reasonable downtime, and a reasonable administrative charge for claim processing. YOU ARE RESPONSIBLE FOR ALL MECHANICAL DAMAGE TO THE TRAILER RESULTING FROM YOUR VIOLATION OF THIS AGREEMENT, such as overloading or failing to maintain the towing vehicle as directed. Charges for physical damage are based on our repair experience and may be higher or lower than our actual costs for parts, labor, and outside repairs. If the trailer is stolen or damaged beyond repair (total loss), you will pay the higher of its book value or actual cash value before the loss, less salvage value. For unreturned or damaged accessories, you will pay replacement costs plus an administrative fee. IMMEDIATELY REPORT ANY ACCIDENT, LOSS, OR THEFT to the “800” number on the back of these Terms and Conditions and complete a Budget Accident Report form promptly. Failure to report within 24 hours may void any protection under this agreement and may result in claim denial.

15. PERSONAL PROPERTY AND CARGO: UNLESS YOU PURCHASE OPTIONAL PERSONAL ACCIDENT AND CARGO PROTECTION (FOR NON-COMMERCIAL RENTALS ONLY), YOU AGREE THAT WE HAVE NO LIABILITY FOR ANY LOSS OR DAMAGE TO YOUR CARGO OR PERSONAL PROPERTY, except when caused solely by our intentional wrongdoing. You assume all risk of such loss or damage and agree to release, indemnify, and hold us harmless from any related claims, damages, or losses.

16. LIABILITY PROTECTION, SUPPLEMENTAL LIABILITY INSURANCE, AND INDEMNITY:

A. Personal Use Liability Protection: For personal vehicle transport trailer rentals, provided there is no prohibited use violation (paragraph 4), we offer limited liability protection for bodily injury (including death) and property damage to third parties (excluding those listed below) resulting from the trailer’s use by you or any Authorized Additional Driver, up to the minimum financial responsibility limits required by the jurisdiction where the accident occurs. The limit for bodily injury to one person includes any claims for loss of consortium or services. Where law extends protection to non-permitted drivers, the same limits apply. This protection complies with financial responsibility laws via insurance, bond, certificate, self-insurance, or a combination, at our discretion, including all notice and cooperation requirements. Where permitted by law, this protection is secondary to any other applicable insurance available to you, any driver, or any passenger, and will apply only to the extent needed to meet minimum financial responsibility limits and/or no-fault benefits when combined with other available insurance. This protection excludes: i) fines, penalties, punitive or exemplary damages; ii) bodily injury or death to you, the driver, family members residing with you or the driver, or any trailer occupant; iii) defense against claims exceeding protection limits; and iv) non-compulsory uninsured/underinsured motorist coverage, supplemental no-fault insurance, or any optional insurance that can be waived. To the extent permitted by law, we and you waive and reject all such non-compulsory optional insurance. If a use restriction is violated, but law requires us to provide protection, the same limitations apply. If applicable law requires different protection, it will not exceed minimum financial responsibility limits and/or no-fault benefits in the accident jurisdiction.

B. Commercial Use Liability Coverage: For commercial (non-personal) vehicle transport trailer rentals, you must select liability coverage or provide a certificate of insurance as per Paragraph 17 below.

C. BASIC LIABILITY INSURANCE (BLI): When added to the Rental Agreement, we extend our coverage to take primary position up to 100/300/25. Your own liability insurance will not be called on to contribute unless, and until, the 100/300/25 has been exhausted. This coverage extension comprises $100,000 bodily injury (one party max) or $300,000 bodily injury (all parties max) and $25,000 for property damage.

D. SUPPLEMENTAL LIABILITY INSURANCE (SLI): If you purchase SLI at rental start and pay the fee, higher liability limits apply. SLI provides primary protection with combined limits of $1,000,000 per accident for bodily injury, death, or property damage, instead of the minimum limits in paragraph 16A. SLI is provided under a separate excess liability insurance policy, detailed in a brochure at the rental counter, and is subject to all conditions and limitations of paragraph 16A, except that the SLI policy terms always control. SLI protects against third-party claims ONLY. You remain responsible for all trailer damage unless you purchased PDW, LDW, or CDW (see Paragraphs 13 and 14) or your personal auto insurance covers such damage. Consult your insurance agent regarding your policy coverage.

E. Indemnification: You agree to release, indemnify, and hold us and our insurers harmless from any expense (including attorney fees), damage, and/or liability arising from the trailer’s use, which: i) exceeds the liability limits in Paragraphs 16A, 16B, 16C, or 16D, or ii) is excluded or not covered under Paragraph 16A, 16B, 16C, or 16D.

F. Exclusions to Liability Protection: Subject to law, protection under Paragraphs 16A, 16B, 16C, or 16D does NOT apply: (i) if the trailer is obtained, used, or operated in violation of paragraph 4; (ii) to loss or damage to your property, in the trailer or in your care, custody, or control; and (iii) to any trailer not rented from us or not attached to the towing vehicle.

17. COMMERCIAL ACCOUNT INSURANCE:

A. Commercial Account Customer Insurance: If you are a commercial account customer, you may provide your own liability insurance instead of purchasing our coverage and waivers. If you choose this option, you agree to insure the vehicle transport trailer under a standard automobile liability policy, naming worldtransport.net and Budget Rent A Car System, Inc. as additional insureds, covering all risks of loss or damage to persons or property arising from the trailer’s ownership, maintenance, use, or operation during the rental, regardless of fault. Minimum insurance limits are a combined single limit of $750,000 for all bodily injury and property damage per accident, or higher if required by us. Provide a certificate of insurance evidencing required coverage and limits before trailer use. Optional SLI is unavailable if you provide your own liability insurance.

B. Commercial Customer Indemnification: You agree to release, indemnify, and hold us and our insurers harmless from any expense (including attorney’s fees and court costs), damage, and/or liability arising from your possession, use, or operation of the trailer, which are (i) in excess of your liability insurance limits, (ii) excluded from your insurance coverage, or (iii) not covered by your insurance. If state law requires us to extend liability insurance protection, it will be limited as per paragraph 16A, notwithstanding your insurance election. You acknowledge that your rental rate is partly based on your provision of complete insurance coverage and indemnification.

18. INDEMNIFICATION AND WAIVER: You shall defend, indemnify, and hold us, our parent, and affiliated companies harmless from all losses, liabilities, damages, injuries, claims, demands, awards, costs, attorney fees, and other expenses incurred by us in any way from this rental transaction or trailer use by you or any person, including third-party claims or liabilities. You may claim under your insurance, but you remain ultimately responsible to us for all such losses. You waive any claim against us for incidental, special, or consequential damages related to the rental.

19. TOWING EQUIPMENT LIABILITY: YOU ASSUME ALL RISKS IN OPERATING, USING, OR POSSESSING ANY TOWING EQUIPMENT AND RELEASE, INDEMNIFY, AND HOLD US HARMLESS FROM ANY CLAIMS FOR BODILY INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM YOUR USE, POSSESSION, OR OPERATION OF TOWING EQUIPMENT, unless solely due to our fault. Any vehicle towed must be the vehicle identified in the Rental Document and must not contain passengers or cargo. You are responsible for all loss and damage to any towed vehicle. However, if you purchase Auto Tow Protection (non-commercial rentals only), our responsibility for damage to a towed car is limited as per this agreement and Auto Tow Protection terms (paragraph 20), up to the amount on the Rental Document. 20. OPTIONAL PERSONAL ACCIDENT AND CARGO PROTECTION: THIS OPTION IS FOR NON-COMMERCIAL CUSTOMERS ONLY. To apply, you must select and pay for this protection at rental start. Personal Accident and Cargo Protection is offered by an independent insurance company and detailed in a brochure at the rental counter.

21. OPTIONAL AUTO TOW PROTECTION: THIS OPTION IS FOR NON-COMMERCIAL CUSTOMERS ONLY. To apply, you must select and pay for this protection at rental start. The towed vehicle must be the type specified in the Rental Agreement. Auto Tow Protection is offered by an independent insurance company and detailed in a brochure at the rental counter.

22. OPTIONAL ROADSIDE SAFETYNET™: THIS OPTION IS FOR NON-COMMERCIAL CUSTOMERS ONLY and is available at participating locations. If you accept Roadside SafetyNet™ (“SafetyNet”) at rental start and are not in violation of this agreement, you will not be responsible for roadside service costs for: flat tire assistance, tire replacement, rim replacement, key replacement, lockout service, jump start, towing to the nearest authorized repair facility (excluding collision-related towing), and fuel delivery (up to $10.00 of fuel). ENGINE DAMAGE IS NOT COVERED. SafetyNet is void if you (or any Authorized Driver) violate this agreement before or during the roadside assistance incident, including prohibited uses. Standard charges and service fees will apply in such cases, regardless of whether we terminate the rental.

23. ARBITRATION:

Pre-Dispute Resolution: Before any legal proceeding (arbitration, small claims, etc.), you and worldtransport.net agree to provide 30 days’ written notice of the claim and make a good faith effort to resolve it. If you have a claim against us, send notice to: worldtransport.net, Legal Department, [Your Company Address]. If we have a claim against you, we will send notice to your address in our records. SETTLEMENT DEMANDS OR OFFERS IN THIS PROCESS ARE NOT ADMISSIBLE IN ANY PROCEEDING.

Dispute Resolution: Except as below, any unresolved dispute related to your vehicle transport trailer rental and these terms will be exclusively settled by binding arbitration via the American Arbitration Association (AAA) under its commercial arbitration rules. THERE IS NO JUDGE OR JURY IN ARBITRATION. PROCEDURES ARE SIMPLER AND COURT REVIEW IS LIMITED. YOU AND worldtransport.net AGREE TO INDIVIDUAL ARBITRATION, NOT CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTIONS. If the class-action waiver is unenforceable, neither party is entitled to arbitration. For individual claims under $10,000, if arbitration costs are prohibitively high compared to litigation costs, we will pay arbitration fees deemed necessary by the arbitrator to prevent cost-prohibitive arbitration. This agreement is under the Federal Arbitration Act. The arbitrator’s award is enforceable in any court. If we modify the arbitration agreement, such changes will not apply to claims for which you have already given notice. AAA information and claim filing details are available at 800-778-7879 or http://www.adr.org. Small claims court matters and personal injury/vehicle damage/loss claims related to your vehicle transport trailer rental are exempt from this arbitration provision.

24. GPS TRACKING: We use GPS tracking to locate trailers deemed missing, abandoned, stolen, or suspected stolen, as required by law enforcement, to identify damaged trailers needing roadside assistance, in emergencies posing safety threats, or to protect our rights. GPS may also be used to process rentals, including start/end times, fuel levels, and mileage, where equipped and legally permitted.

25. PRIVACY DISCLOSURE: We collect, use, and share your personal information (PI) with affiliates, licensees, and third parties to: (a) provide requested services, including discounts and loyalty programs; (b) conduct identity, security, license, and credit checks; (c) manage and improve our services; (d) protect our interests and enforce our rights; (e) protect rights, privacy, safety, and property; (f) comply with law; and (g) provide marketing information, unless you opt out. You can limit marketing use and access/correct your PI. Some towing vehicles contain devices monitoring condition, performance, operation, and driver behavior (speed, fuel consumption, distance, location). This data may be used during and after rental, if legally allowed. We may transfer your PI outside your rental country, subject to other countries’ laws, to provide services or operate our business. By using our services, you consent to our PI collection, use, and sharing as long as legally permitted. Reservation Terms and Conditions

Reservations guarantee rates upon credit card deposit confirmation and reflect customer preferences for pick-up/drop-off locations, rental time/date, and equipment type.

Pick-up/drop-off locations and rental times/dates are preferences only. We reserve the right to offer alternatives if preferences are unavailable.

Equipment is subject to availability at pick-up. We may substitute equipment at no extra charge if requested equipment is unavailable.

Online rates exclude taxes, fees, surcharges, accessories, protection plans, deposits, moving supplies, and other charges. Charges are provided at pick-up.

Cancellations or modifications require 48-hour notice before pick-up time/date listed on the Thank You page and confirmation email. Contact the pick-up location or call 1-800-MOVETRUCK. Failure to notify within this timeframe may result in a $75 Cancellation Fee. Modifications may change reservation rates.

A $75 No Show Fee applies if no rental agreement is opened within 24 hours of the proposed pick-up time.

One-way rental trip durations are estimates only. Mileage and duration may vary. Additional days/miles can be purchased by contacting the pick-up location before pick-up during business hours ($70/day, $0.70/mile). Additional days/miles purchased at or after pick-up are $85/day and $0.85/mile. Pre-paid additional days/miles are non-refundable.

Local rentals are charged for actual miles and days used.

Online discounts cannot be combined with other offers.

One-way rental average deposit is $150. Local rental average deposit is the greater of $150 or 1.5 times estimated charges, but may be higher in metro areas.

Credit/debit card payments require the cardholder’s presence at rental.

Two forms of valid ID are required at rental, including a valid U.S. Driver’s License. Acceptable IDs include: U.S. Driver’s License, State ID, Passport, Social Security Card, Vehicle Registrations, Phone Bill, Military ID, business photo ID, major credit card, paycheck/stub. All drivers must have a valid U.S. Driver’s License.

Towing equipment recommendations are based on manufacturer guidelines and customer-provided vehicle information. Different vehicles need different equipment. Some vehicles are unsuitable for towing. We are not liable for towing damages and do not guarantee equipment fitness for particular uses. We will attach towing equipment but customers are responsible for loading vehicles onto it, following provided instructions.

Local rentals returned late are subject to:

  • Returns after the contracted date incur an additional day charge at 100% of the going daily rate, plus 100% of daily rates for protection products and accessories.
